Whether you are looking for ways to stay safe on your bike or have been injured in a motorcycle accident, the following Wisconsin motorcycle laws can be important to you:

  • Motorcycle helmet laws: Under Wisconsin law, an insurance company cannot admit evidence that a helmet could have prevented a head injury. If you are over 18, you do not need to wear a helmet in Wisconsin. Insurers cannot use this against you. However, it is highly advisable to wear one.
  • Contributory negligence: Under Wisconsin law, for an injured party to collect compensation, the at-fault party must be at least 50% at fault. If the at-fault party is not at least 50% negligent, the injured person may be unable to collect compensation. The monetary recovery is reduced according to fault apportionment.
  • Direct action statute: This is a law unique to Wisconsin. The injured party does not need to sue the negligent party directly. Rather, you sue the person's insurer.
